TERMS AND CONDITIONS

 

  1. INTRODUCTION
  2. These Terms and Conditions are issued pursuant to Article 8, Section 1, Item 1 of the Act of 18 July 2002 on the Provision of Electronic Services and are made available free of charge in a form that allows for downloading, saving, and printing.
  3. The Terms and Conditions define the general principles and technical requirements for using the Website, the principles for concluding and terminating Agreements for the provision of Electronic Services, intellectual property rights, and the complaints procedure.

 

  1. DEFINITIONS
  • Antiquarian Bookstore – Paweł Kolata, the Website manager, conducting business under the name ANTYKWARIAT SOBIESKI PAWEŁ KOLATA, entered into the Central Register and Information on Business Activity, with its registered office in Kalisz, address: ul. Pułaskiego 31/3, 62-800 Kalisz, Tax Identification Number (NIP): 618-185-33-69; REGON 251642669, email address: sklep@antyksobieski.pl
  • Customer - a natural person, legal entity, or organizational unit without legal personality who uses Electronic Services or purchases Goods through the Website under the terms and conditions specified in the Terms and Conditions.
  • Guest - a Customer using the pl Website without having an Account or being logged in to it.
  • Personal Data - all information identifying a natural person, as well as the device IP, location data, online identifier, including information collected via cookies and other similar technologies, including data processed as part of the use of the artificial intelligence-based chat function by Antykwariat and processed by it under the terms and conditions specified in the Terms and Conditions and Privacy Policy.
  • Consumer - a natural person entering into a legal transaction with Antykwariat that is not directly related to their business or professional activity. Account – a free electronic service consisting of a separate section of the Website containing a set of information and permissions assigned to a specific Customer, designated with a unique name (login) and secured with a password, where the Customer's Personal Data and information about their activities within the Online Store are collected, including the history of placed Orders and payments made;
  • Login – a string of characters entered by the Customer when creating an Account, enabling subsequent identification when using the Online Store. The Login, as a technically unique string of characters, does not change after the Account is created.
  • Newsletter – a free electronic distribution service provided by the Antiquarian Bookstore via email, which allows all interested parties to periodically and automatically receive information from the Antiquarian Bookstore about services, products, new items, promotions, competitions, and events, provided under the terms and conditions described in the Terms and Conditions. Payment Operator - the entity indicated on the Website that operates the electronic payment system.
  • Entrepreneur - a natural person, legal person, or organizational unit other than an individual, possessing legal capacity, conducting business activities, as well as partners in a civil partnership within the scope of their business activities.
  • Entrepreneur with Consumer Rights - a natural person entering into a contract with an Antiquarian Bookstore directly related to their business activity, when the content of the contract indicates that it is not of a professional nature for that person, arising in particular from the subject of their business activity, made available pursuant to the provisions of the Central Register and Information on Business Activity.
  • Terms and Conditions - this document defining the rights and obligations of the Antiquarian Bookstore and the Customer/Guest, as well as the terms and conditions for placing Orders and concluding Sales Agreements.
  • Registration - the process of creating an Account via the registration form available on the Website, consisting of the Customer providing and then saving the required data on the Website and gaining access to specific Website resources. The Registration process includes, among other things, selecting the appropriate ID (login), password, and contact details. Website - an IT solution located at antyksobieski.pl and possibly other internet addresses, comprising a set of interoperable computer programs, databases, and accompanying elements (e.g., graphics), combined into a single IT system enabling Customers to browse content, register, manage their Account, and order Goods;
  • Online Store - a functionality of the Website through which a Customer/Guest can place an Order and purchase Goods and Services offered by the Antiquarian Bookstore;
  • Electronic Service - the provision of a service without the simultaneous presence of the parties (remotely), through the transmission of data at the Customer's individual request, transmitted and received using electronic processing devices, including digital compression, and data storage, which is entirely transmitted, received, or transmitted via a telecommunications network within the meaning of the Act of 16 July 2004 - Telecommunications Law.
  • Goods - movable items, in particular books, magazines, maps, antique books, and other collectibles offered for sale by the Antiquarian Bookstore through the Online Store;
  • Contract - an agreement for the provision of electronic services concluded between the Customer and the Antiquarian Bookstore using the Website under the terms and conditions set forth in the Terms and Conditions;
  • Sales Agreement - an agreement for the sale of Goods within the meaning of the Civil Code, concluded between the Antiquarian Bookstore and the Customer using the Online Store;
  • Electronic Service - an automated service provided electronically via a telecommunications network using information technology and requiring minimal human intervention;
  • Order - a declaration of intent by the Customer, constituting an offer to conclude a Sales Agreement submitted to the Antiquarian Bookstore under the terms and conditions set forth in the Terms and Conditions;

 

  1. GENERAL PROVISIONS.
  2. Use of the Website is voluntary for each Customer.
  3. The Website is made available by the Antiquarian Bookstore via the Internet as a resource of its IT and communications systems. All rights to the Website, including copyrights, intellectual property rights to its name, internet domain, and materials, belong to Antykwariat, and may only be used in a manner specified in and in accordance with the Terms and Conditions, applicable law, and general principles of internet use, in a manner that does not infringe the rights of Antykwariat or the rights of third parties from the moment of the first activity related to using the Website.
  4. Using the Website means any activity that leads to viewing the content presented therein.
  5. As part of the Website, Antykwariat offers the following electronic services:
  • browsing the Website;
  • using the Account and related functionalities;
  • subscribing to the Newsletter;
  • placing Orders;
  • using the chat based on artificial intelligence (AI);
  1. Access to the full functionality of the Website requires Account Registration.
  2. Guests may only use limited features of the Website under the terms and conditions specified in the Terms and Conditions.
  3. To successfully register an Account, the Customer must carefully read the Terms and Conditions and accept their provisions.
  4. Customers are prohibited from providing illegal content or using the Website in a manner that violates the law, good practices, infringes upon the personal rights of third parties, or violates the legitimate interests of the Antiquarian Bookstore. Actions that may hinder or destabilize the operation of the Website or expose the Antiquarian Bookstore to loss of reputation, good name, or any other damage are prohibited, including, in particular:
  • sharing content that is unlawful, harmful, threatening, obscene, violent, offensive, defamatory, vulgar, invasive of another person's privacy, hateful, or otherwise objectionable; Impersonating any person or entity, or falsely stating or otherwise misrepresenting one's affiliation with a person or entity;
  • attempting to disable, weaken, or destroy the Website;
  • transmitting, storing, or sharing content or code containing viruses, malicious code, malware, or any components intended to damage or limit the functionality of the Website;
  • taking actions that may overload the Website;
  • as well as any other actions that affect the proper functioning of the Website.
  1. Using the Antiquarian Bookstore's trademarks without its consent, including characteristic graphic elements, data, and other information, is also prohibited.
  2. The Customer is entitled to use the Website's resources only for its own use. The Antiquarian Bookstore does not consent to the Customer using the resources and functions available on the Website to conduct any activity that would infringe the Antiquarian Bookstore's interests.
  3. In the event of a Customer's violation of the Terms and Conditions, the Antiquarian Bookstore will take appropriate action appropriate to the nature of the violation, including the possibility of deleting the Account and preventing re-registration.
  4. The Antiquarian Bookstore reserves the right to post advertising content on the Website regarding its own products and services, as well as those of its contractors, in the forms commonly used online.
  5. The Antiquarian Bookstore will communicate with the Customer using the email address provided during the registration process.
  6. The Terms and Conditions constitute an integral part of all sales agreements concluded by the Antiquarian Bookstore, including those concluded through an Order placed via email or telephone.
  7. In addition to the Terms and Conditions, additional regulations supplementing the Terms and Conditions may apply, particularly regarding additional services.

 

  1. TECHNICAL REQUIREMENTS.

 

  1. The Customer must meet the following technical requirements to use the Website:
  • Internet access;
  • An end device (computer/tablet/mobile phone) that allows access to the Internet and has a functioning operating system;
  • An internet browser version that provides access to internet resources, such as Internet Explorer, Google Chrome, Mozilla Firefox, Apple Safari, or another compatible browser that supports cookies, must be installed on the device referred to above.
  1. To use the full functionality of the services available on the Website, it is necessary to enable cookies and other similar technologies in the Customer's web browser.
  2. To use certain services (e.g., Newsletter, placing Orders), the Customer must have an active email account running on any server, through which the Customer can send, receive, and store messages and other data within an email service separate from the Website.
  3. The technical terms of use of the Website are important for its proper functioning and appearance in the web browser used by the Customer, as well as for the security of data presented on the Website. Each Customer should adhere to these terms and guidelines, and any actions taken by the Customer that deviate from these terms (intentional or unintentional) are their sole responsibility.
  4. Before using the Website, the Customer is obligated to check whether their device meets the technical requirements specified in the Terms and Conditions. Should any doubts arise regarding the technical feasibility of using the Website, please send an appropriate inquiry to the Antykwariat at sklep@antyksobieski.pl.
  5. Antykwariat will exercise due diligence to ensure proper use of the Website; however, it does not guarantee that there will be no problems accessing the content presented on the Website. Such incidents, along with a detailed description, should be reported to the Antiquarian Bookstore at the following email address: sklep@antyksobieski.pl
  6. The Antiquarian Bookstore informs that technical problems or limitations occurring on the Customer's equipment (e.g., firewalls, inappropriate browser versions, antivirus software, Adblock Plus or Flashblock software, and others) may limit or prevent access to the electronic services offered on the Website.
  7. The Antiquarian Bookstore provides electronic services via the Website 24 hours a day, 7 days a week, year-round.
  8. The Antiquarian Bookstore reserves the right to maintenance breaks. The Antiquarian Bookstore will, to the extent possible, provide information about maintenance breaks and their duration through available means, in particular by posting appropriate notices on the Website.
  9. All actions taken by third parties who have access to the Customer's device while actively logged in to the Website are recorded as actions of that Customer. The Customer is solely responsible for the consequences of sharing the device with other people or leaving it unattended.
  10. The Antiquarian Bookstore is not responsible for any problems related to the use of the Website caused by a lack of internet access on the Customer's part.

 

  1. VIEWING THE CONTENT OF THE SERVICE
  2. As part of the Service, the Antiquarian Bookstore allows Customers to browse its content, which occurs each time they enter the Service's website. Using the Service does not require registration and is entirely voluntary and free of charge.
  3. The service agreement for viewing information posted on the Service is concluded for a fixed term and terminates when the Customer closes the Service's website. The provisions of the Service's Privacy Policy and Cookie Policy apply accordingly.
  4. The Antiquarian Bookstore reserves the right to remove, modify, or add to the content presented on the Service at any time.

 

  1. ACCOUNT REGISTRATION

 

  1. The Account allows the Customer to:
  • place Orders,
  • conclude Sales Agreements within the Online Store,
  • view the history of placed Orders and payments made.

 

  1. Account registration is voluntary and free of charge. To successfully register an Account, the Customer must carefully read the Terms and Conditions and accept their provisions.
  2. The Customer may only have one Account registered on the Website.
  3. To register, the Customer must provide the data marked as mandatory in the registration form, specify their ID (Login) and password, which will be used to identify them on the Website, accept the Terms and Conditions by checking the appropriate box, and then click the "Register" button or similar.
  4. Registration on the Website is not possible using a Login previously used by another Customer.
  5. Approval of the registration form completed by the Customer constitutes a declaration that the data provided in the form is accurate and that they are authorized to use this data.
  6. After confirming the registration form, the Customer will receive an email message at the provided email address informing them of the Account activation, along with the current Terms and Conditions. At this point, an indefinite contract for the provision of electronic Account management services is concluded, and from that moment on, the Customer can log in (authorize) to the Website and use its functionalities.
  7. A registered and logged-in Customer may edit and correct the data provided during Registration, with the exception of the Login (ID), which remains unchanged.
  8. The Customer is obligated to keep the Login and password for their individual Account on the Website confidential. It is prohibited to share the Account with other Customers or undertake any IT or other activities aimed at obtaining passwords and Logins to other Customers' Accounts.
  9. For natural persons, full legal capacity is required to create an Account.
  10. A Customer who is a legal entity or an organizational unit without legal personality is solely responsible for providing and maintaining a valid email address for correspondence with the Antiquarian Bookstore, and is also solely responsible for ensuring that such communication takes place only through the person or persons authorized by the Customer.
  11. The Customer may terminate the Agreement for the provision of electronic Account management services at any time by sending an appropriate message directly to the Antiquarian Bookstore at the following email address: sklep@antyksobieski.pl.
  12. The Antiquarian Bookstore will immediately, no later than 7 days after receiving the termination notice, delete the Customer's Account from the Website. If the Customer terminates the Agreement after placing an Order, the Antiquarian Bookstore will delete the Account no earlier than after the Order has been completed.
  13. The Antiquarian Bookstore is entitled to terminate the Agreement and delete the Account if the Customer violates the Terms and Conditions.
  14. Deleting the Account will terminate the Agreement for the management of the Account, and from that moment on, the Customer loses access to information provided or generated during the use of the Website.
  15. In the event of the death of a Customer who is an individual, or the liquidation of a Customer who is a legal entity or an organizational unit without legal personality, the agreement for use of the Website's resources expires. Antytkwariat will delete the Account after the authorized person reports and demonstrates the circumstances constituting the basis for termination of this agreement.

 

  1. NEWSLETTER SERVICE
  2. The Newsletter Service is free and is available from the moment of successful subscription (order) by selecting the appropriate checkbox in the Order Form when placing an Order, or via the dedicated Registration Form on the Website.
  3. As part of the Newsletter Service, Antykwariat sends the ordered electronic newsletter to the email address provided by the Customer, containing, in particular, commercial information regarding the products and services offered by Antykwariat.
  4. The recipient's ability to use the Newsletter Service is contingent upon having an active and properly configured email account.
  5. Each Newsletter from Antykwariat contains:
  • information about the sender;
  • a completed "subject" field specifying the content of the message;
  • information on how to unsubscribe from the Newsletter.
  1. The Newsletter Service is provided for an indefinite period. The Customer may unsubscribe from the Newsletter Service (resignation) at any time and without providing a reason, in particular by clicking the deactivation link included in every message sent to them as part of this service or by sending a relevant request to the Antykwariat via email to sklep@antyksobieski.pl or in writing to the Antykwariat's registered office address.

 

  1. ONLINE STORE
  2. The Online Store is available on the pl website. Use of its functionality is free of charge.
  3. Information about the Products presented in the Online Store does not constitute an offer within the meaning of the Civil Code; it constitutes an invitation to enter into a Sales Agreement within the meaning of Article 71 of the Civil Code.
  4. Placing an Order or registering an Account requires prior review of the Terms and Conditions and acceptance thereof by checking the appropriate box (the "I accept the Terms and Conditions" checkbox). Failure to check this box will prevent the action from being completed. Orders are accepted via forms available directly in the Online Store.
  5. An order placed through the Online Store is effective if the Customer correctly completes the Order form, providing the Personal Data indicated as mandatory, the payment method, and the delivery location and method.
  6. Orders can be placed in the Online Store 24/7, however, orders placed on non-working days (Sundays and public holidays) will be processed on the next business day.
  7. An order constitutes an offer within the meaning of the Civil Code, submitted to the Antiquarian Bookstore by the Customer.
  8. The selection of Goods is made by adding the Goods to the virtual shopping cart. Placing the Goods in the virtual shopping cart does not constitute a reservation. If the available Goods are exhausted before the Customer confirms the Order, the Antiquarian Bookstore reserves the right to reject the offer to purchase such a Product and not fulfill the Order, of which the Customer will be immediately informed.
  9. After the Customer provides all the required data, a summary of the submitted Order will be displayed, which will include information about:
  • the subject of the Order,
  • the unit and total price of the ordered Goods,
  • the selected delivery method and costs,
  • and the selected payment method.
  1. When placing an Order for Goods, until the "ORDER AND PAY" button is pressed, the Customer can modify the entered data, including the selection of Goods, in accordance with the displayed messages and information.
  2. Clicking the "ORDER AND PAY" button constitutes the Customer's offer to purchase the Goods they have selected, pursuant to the terms and conditions described in the Terms and Conditions.
  3. After placing a valid Order, the Customer will receive a reply message from the Antiquarian Bookstore to the email address they provided, containing basic information regarding their Order, including: the quantity of Goods ordered, their price and shipping costs, the selected delivery and payment method, and the estimated Order processing time. Confirmation of receipt of the Order does not constitute acceptance of the Customer's offer by the Antiquarian Bookstore.
  4. After receiving the Order, the Antiquarian Bookstore will verify it and then send the Customer another message to the email address they provided, confirming the fulfillment of the Customer's Order ("Order Confirmation"), which constitutes acceptance of their offer and the conclusion of a Sales Agreement pursuant to the terms and conditions described in the Terms and Conditions.
  5. During the Order processing (i.e., after it has been placed), the Customer cannot modify the data contained in the Order.
  6. If only part of the Order is accepted by the Antiquarian Bookstore for processing, the conclusion of the Sales Agreement applies only to the Goods confirmed by the Antiquarian Bookstore.
  7. The Order processing time, understood as the time within which the Antiquarian Bookstore will complete the Order and forward it for shipment, is provided on the website containing the description of the given Good.
  8. The Order is processed after the Antiquarian Bookstore receives payment.

 

8A. CHAT BASED ON ARTIFICIAL INTELLIGENCE (AI)

  1. As part of the Website, the User can use a chat function based on artificial intelligence technology provided by OpenAI.
  2. AI Chat enables automatic generation of responses to User inquiries and is an electronic information service.
  3. Responses generated by the AI ​​Chat are automated and may contain errors, inaccuracies, or outdated information.
  4. They do not constitute legal, medical, financial, or other professional advice. Users use AI chat voluntarily and at their own risk.
  5. The Administrator is not responsible for the consequences of the User's use of information obtained through AI chat.
  6. As part of AI chat, data provided by the User in the conversation and technical device data, including the IP address and session ID, may be processed.

 

  1. DELIVERY
  2. The Antique Shop delivers the Goods to the Customer in accordance with the terms specified in the Order.
  3. Delivery takes place on Business Days. Orders placed on non-business days are considered placed on the first Business Day following the date of placing the Order.
  4. Delivery of Goods is subject to payment. The costs of delivery of the Goods (including transportation, delivery, and postal fees) are borne by the Customer. Their amount is indicated to the Customer when placing the Order.
  5. Personal collection of Goods by the Customer is free of charge and is possible after payment has been made.
  6. Shipping of Goods can only occur after payment has been made and the funds have been credited to the Antique Shop's bank account.
  7. The Goods are delivered to the address provided by the Customer. Collection of the shipment by the Customer or a person who has demonstrated authorization to collect the shipment on their behalf is considered effective delivery of the Goods.
  8. The Antique Shop is not responsible for an incorrect delivery address provided by the Customer, nor for the loss or damage of the Goods if they are left by the carrier or courier at the Customer's request and with their consent with an unauthorized person or at another address, in particular with security, a building manager, a neighbor, a post office box, etc.
  9. Upon release of the Goods, the benefits and burdens associated with the item, as well as the risk of accidental loss or damage, are transferred to the Customer.
  10. For Customers who are Consumers, the release of the Goods is considered to be the receipt of the Goods from the carrier or forwarder.
  11. It is recommended that the Customer who is a Consumer, if possible, inspect the Goods after delivery in the presence of a representative of the entity carrying out the transport or forwarding. If any damage to the shipment is detected, it is also recommended that the Consumer complete an appropriate report and contact the Antique Shop immediately.
  12. For Customers who are Entrepreneurs, the release of the Goods is considered to be the entrusting of the Goods by the Antique Shop to the carrier or forwarder.
  13. A Customer who is an Entrepreneur is obligated to inspect the condition of the Goods upon delivery in the presence of a representative of the entity providing transportation or forwarding. If any damage to the shipment is detected, the Entrepreneur is obligated to complete an appropriate report.
  14. If the Customer refuses to accept the shipment without justification, the Antiquarian Bookstore reserves the right to charge the Customer for the costs of shipping and return to the sender.
  15. PRICES AND PROMOTIONS
  16. Sales prices are indicated for each Product offered on the Website.
  17. All prices displayed on the Website are given in Polish zloty as gross prices, i.e., including the applicable VAT rate.
  18. The parties are bound by the purchase price of the Product if the Customer places a valid Order and the Antiquarian Bookstore accepts it.
  19. Prices do not include delivery costs or other costs of executing the Sales Agreement, in particular additional fees charged by payment processors.
  20. The Antiquarian Bookstore reserves the right to change the prices of Products offered in the Online Store. These changes do not apply to Orders placed before the price change.
  21. The Antiquarian Bookstore reserves the right to conduct and cancel all types of promotional campaigns. The right referred to in the previous sentence does not affect Orders placed before the terms of a given promotion come into effect.
  22. As part of announced promotions, the Antiquarian Bookstore reserves the right to introduce restrictions, which will be specified in the terms of the promotion.
  23. Promotions in the Online Store cannot be combined unless the terms and conditions of a given promotion state otherwise.

 

  1. PRESENTATION OF GOODS
  2. The Goods offered on the Website are collectible, antique, and/or used, and therefore may have traces of use, wear, or other characteristics related to their age and history.
  3. Each Good is individually described, and its technical and visual condition is presented in a manner consistent with the actual condition of the item at the time of listing.
  4. Images of the Goods are for illustrative purposes only and may differ slightly from the actual appearance of the item, particularly in terms of color, lighting, or quality of the display on the Customer's device.
  5. Due to the unique nature of the Goods (single items or limited series), they may be sold before placing or confirming the Order, of which the Customer will be immediately informed.
  6. Information about the Goods published on the Website does not constitute a guarantee of their unchanging availability, and their presentation is for informational purposes and an invitation to conclude a Sales Agreement.
  7. Unless otherwise indicated in the description of the Goods, the Goods are not subject to the possibility of exchange for a brand new item, due to their individual, collector's character.

 

  1. PAYMENTS
  2. Payment transactions within the Website are handled by external Payment Operators.
  3. To make a payment on the Website, the Customer must have a payment card and/or a bank account or other payment method supported by the Payment Operator (payment method).
  4. After selecting a payment method, the Customer is required to provide the necessary data required by the Payment Operator to complete the transaction.
  5. Before making a payment, the Customer should review and accept the payment terms and conditions provided by the Payment Operator.
  6. The terms and conditions for using the payment transfer services referred to in paragraph 4 above define the Payment Operator's liability for the proper performance of the payment transfer service and the rules for handling complaints related to payments made in this manner.
  7. For some payment methods, the external Payment Operator may charge the Customer additional fees, such as foreign transaction fees or other fees related to the selected payment method. For detailed information, the Customer should contact the Payment Operator processing the payment.
  8. By accepting the provisions of the Terms and Conditions, Customers who are not Consumers consent to the sending of VAT invoices and VAT invoice corrections electronically.

 

  1. WITHDRAWAL FROM THE CONTRACT
  2. A Customer who is a Consumer within the meaning of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827) or an Entrepreneur with consumer rights has the right to withdraw from the Agreement within 14 (fourteen) days of its conclusion, and in the case of Sales Agreements, within 14 (fourteen) days of the Goods being taken into possession by the Consumer/Entrepreneur with consumer rights or a third party designated by them, other than the carrier, without providing any reason.
  3. The period for withdrawal from the Sales Agreement begins on the day on which the Customer takes possession of the Goods or on which a third party designated by them, other than the carrier, takes possession of the Goods. To meet the withdrawal deadline, it is sufficient to send a declaration of withdrawal before the deadline specified in paragraph 1 above.
  4. Exercise the right of withdrawal by informing the Antiquarian Bookstore by means of a clear declaration of withdrawal. The declaration of withdrawal may be submitted on the form provided in Appendix 1 (Consumer) or Appendix 2 (Entrepreneur with consumer rights) to the Terms and Conditions, but this is not mandatory.
  5. The Antiquarian Bookstore allows Customers who are Consumers or Entrepreneurs with consumer rights to submit a declaration of withdrawal from the Sales Agreement also through the Customer Account functionality available on the Website, in particular through the "Return Order" option available next to the details of the given Order.
  6. Using the functionality referred to in paragraph 4 constitutes an equivalent method of submitting a declaration of withdrawal from the contract to written and electronic forms, in particular email, and has the same legal effects as submitting the declaration in another manner provided for in the Terms and Conditions.
  7. If a declaration of withdrawal from the Sales Agreement is submitted via the Customer Account, the Antiquarian Bookstore will confirm its receipt on a durable medium (specifically, by email) immediately after registering it in the system.
  8. In the event of an effective withdrawal from the Sales Agreement, it is deemed not to have been concluded. The Antiquarian Bookstore will immediately, but no later than 14 days from receipt of the Customer's declaration of withdrawal from the Sales Agreement, refund all payments received from the Customer, including the costs of delivery, excluding additional costs resulting from the Customer's choice of a delivery method other than the least expensive standard delivery method offered by the Antiquarian Bookstore.
  9. The refund will be made using the same payment method used by the Customer, unless the Customer expressly agrees to another solution that does not incur any costs for the Customer.
  10. The Antiquarian Bookstore may withhold the refund of payments received from the Customer until the Goods are received back or the Customer provides proof of sending them back, whichever occurs first.
  11. The Customer is obligated to return the purchased Goods immediately, but no later than 14 days after withdrawing from the contract.
  12. The costs of returning the Goods are borne by the Customer.
  13. A consumer entrepreneur loses consumer protection rights if the Sales Agreement concluded with the Antiquarian Bookstore is of a professional nature, verified based on the entrepreneur's entry in the Central Register and Information on Economic Activity of the Republic of Poland, in particular the Polish Classification of Activities codes indicated therein.
  14. Consumer entrepreneurs are not covered by the institutional protection provided to consumers by district consumer ombudsmen and the President of the Office of Competition and Consumer Protection.
  15. COMPLAINTS
  16. The Antiquarian Bookstore is liable to the Consumer and the Consumer Entrepreneur for the lack of conformity of the Goods with the Agreement, under the terms specified in applicable law, in particular the Act of May 30, 2014 on Consumer Rights.
  17. All complaints may be submitted, in particular, regarding the lack of conformity of the Goods with the Agreement and should be submitted to the following email address: sklep@antyksobieski.pl, providing a description of the complaint, the circumstances of its submission, and the identifying information of the complainant.
  18. The Antiquarian Bookstore is not liable to the extent that the lack of conformity results from:
  • . errors or actions of the Consumer,
  • . malfunction of the Internet browser, device, or telecommunications connections on the Consumer's side,
  • . actions of third parties unrelated to the Antiquarian Bookstore in the performance of the Agreement.
  1. If the data contained in the complaint requires supplementation, the Antiquarian Bookstore will ask the Consumer to provide it before considering the complaint.
  2. If the Goods are found to be non-conforming with the Agreement, the Consumer has the right to request their repair or replacement.
  3. The Antiquarian Bookstore may first repair the Goods, and if this is impossible or involves excessive costs, replace them.
  4. If both repair and replacement are impossible or excessively difficult, the Consumer may exercise the right to a price reduction or withdrawal from the Agreement, in accordance with applicable law.
  5. The Consumer may submit a declaration of price reduction or withdrawal from the Agreement if:
  • . The Antique Shop has refused to bring the Goods into conformity with the Agreement,
  • . The Antique Shop has failed to bring the Goods into conformity with the Agreement,
  • . the lack of conformity is significant,
  • . the lack of conformity persists despite attempts to bring the Goods into conformity,
  • . the circumstances indicate that bringing the Goods into conformity will not occur within a reasonable time or without excessive inconvenience to the Consumer.
  1. The Antique Shop will carry out the repair or replacement within a reasonable time from the receipt of the notification and without excessive inconvenience to the Consumer, taking into account the nature of the Goods and the purpose of their purchase.
  2. The Antique Shop will bear the costs of bringing the Goods into conformity with the Agreement, in particular the costs of shipping, labor, and materials. Due to the collectible and used nature of the Goods, exchanges – if necessary – will be made by providing another item of similar characteristics and condition, subject to availability in the Antiquarian Bookstore and with the consumer's consent.
  3. The Antiquarian Bookstore will consider the complaint within 14 days of its receipt. If supplementation is required, this period will begin on the date the supplementation is received.
  4. A response to the complaint, including the complaint resolution process, will be sent to the email address provided by the Consumer. In particularly justified cases, at the Consumer's request, the response may be sent to a different email address or in writing to the indicated mailing address.
  5. Failure to respond within 14 days will constitute acceptance of the complaint and the fulfillment of the Consumer's request as specified in the complaint.
  6. If the complaint is rejected, the Consumer may pursue out-of-court dispute resolution and redress procedures.

  8. Consumers can also use the ODR platform available at: http://ec.europa.eu/consumers/odr.
  9. A dispute may be submitted to an arbitration tribunal with the consent of both parties. In other cases, common courts have jurisdiction in accordance with the provisions of the Code of Civil Procedure.
  10. PROVISIONS REGARDING ENTREPRENEURS
  11. The provisions of this section apply to Customers who are Entrepreneurs and do not apply to Consumers or Entrepreneurs with consumer rights.
  12. In the case of Sales Agreements between Entrepreneurs, pursuant to Article 558 § 1 of the Civil Code, the Antiquarian Bookstore excludes its liability under the warranty for physical and legal defects of the Goods offered.
  13. The Antiquarian Bookstore's liability towards the Entrepreneur, regardless of its legal basis, is limited – both for a single claim and for all claims in total – to the amount of the price paid. The Antiquarian Bookstore is liable towards the Entrepreneur only for typical damages foreseeable at the time of conclusion of the Sales Agreement and is not liable to the Entrepreneur for lost profits.
  14. The resolution of any disputes between the Antiquarian Bookstore and the Entrepreneur will be submitted to the court having jurisdiction over the Antiquarian Bookstore's registered office.

 

  1. INTELLECTUAL PROPERTY RIGHTS.
  2. The content of the Website, which includes, in particular, but not limited to: text, graphics, logos, sound effects, video materials, registered trademarks, and the compilation, layout, and appearance of the Website, as well as the software enabling its operation, are subject to copyright or industrial property rights and are legally protected. Copyright belongs to the Antiquarian Bookstore and/or its creators.
  3. The Customer is not authorized to copy, distribute, reproduce, aggregate, or modify any data or other information posted on the Website. In particular, automatic downloading of the Website's content and its presentation outside of the Website is prohibited without the written consent of the Antiquarian Bookstore. Direct linking to the Website's materials is permitted.

 

  1. PERSONAL DATA PROTECTION
  2. The Antiquarian Bookstore, as the controller of Personal Data, undertakes to take all necessary technical and organizational measures appropriate to the level of risk, to ensure the security of all Personal Data and content provided by the Customer in connection with their use of the Website.
  3. Personal Data are processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) and the Act of 10 May 2018 on the Protection of Personal Data (Journal of Laws of 2018, item 1000). A Customer who has registered on the Website has the right to access their Personal Data, correct it, and request that it no longer be used. Personal Data can be viewed and changed after logging in to the Website, within their individual Account.
  4. Detailed rules regarding the processing of Customer Personal Data are contained in the Privacy Policy located on the Website.
  5. FINAL PROVISIONS.
  6. The Antiquarian Bookstore reserves the right to amend the Terms and Conditions at any time. This may be due, in particular, to legislative changes or changes in legal practice, the development of internet technologies, or changes in the terms of use of the Website. The Customer will be notified of any changes to the Terms and Conditions at least 14 days in advance. If they do not accept the changes, they have the right to terminate the agreement for the provision of electronic services (in particular, the Account management) with immediate effect before the changes come into effect.
  7. Failure to terminate within this period constitutes acceptance of the changes.
  8. Agreements concluded before the amendments to the Terms and Conditions shall be governed by the version of the Terms and Conditions in force on the date of conclusion of the Agreement.
  9. In the event of the conclusion of ongoing agreements based on these Terms and Conditions (e.g., the provision of an Electronic Service - Account), the amended Terms and Conditions shall be binding on the Customer if the requirements specified in Articles 384 and 3841 of the Civil Code are met, i.e., the Customer was properly notified of the changes and did not terminate the agreement within 14 calendar days of the notification date.
  10. The Antiquarian Bookstore will notify the Customer of any changes to the Terms and Conditions no later than 14 days before the planned date of the changes' implementation by sending an email notification to the Customer's provided address, indicating the effective date of the changes, along with the updated Terms and Conditions, and by posting relevant information about the changes on the Website.
  11. A change in the Antiquarian Bookstore's contact details contained herein, or a change in its data resulting from a change in the legal form of its business, does not constitute an amendment to the Terms and Conditions.
  12. The Terms and Conditions do not exclude or limit any rights of Customers who are Consumers under mandatory provisions of law. In the event of a conflict between the provisions of the Terms and Conditions and mandatory provisions of law granting Consumers certain rights, those provisions shall prevail.

 

  1. In the event of a change or invalidation of any provision of the Terms and Conditions by a decision of a competent authority or court, the remaining provisions shall remain in force and bind the Customer and the Antiquarian Bookstore.
  2. The law applicable to Contracts/Sales Agreements concluded between the Customer and the Antiquarian Bookstore via the Website is Polish law. The Antiquarian Bookstore does not guarantee the accuracy or completeness of information generated by automated tools, including artificial intelligence-based chat.

 

  1. FORCE MAJEURE

The Parties shall not be liable for non-performance or improper performance of obligations under the Agreement if such failure is caused by force majeure.

Force majeure is defined as an external event, beyond the control of the Parties, that could not have been foreseen or prevented even with due diligence, in particular:

  • natural disasters (flood, fire, hurricane, earthquake),
  • war, riots, acts of terrorism,
  • decisions of public authorities preventing the performance of the Agreement,
  • failures or disruptions in the operation of telecommunications, energy, or payment systems,
  • interruptions in the operation of courier or postal services,
  • cyberattacks, failures of IT systems or the Website infrastructure.

In the event of a force majeure event, the affected Party shall immediately notify the other Party of its occurrence and its potential impact on the performance of the Agreement.
